第1条（概要）

Article 1 (Overview)

本規約は、PHC オンラインクリニック（以下、「当院」といいます。）と患者様との間で、当院が提供するオンライン診療サービス（以下、「本サービス」といいます。）の利用に関して必要な事項を定めることにより、本サービスを適正かつ円滑に運営することを目的とし、患者様と当院との間の本サービスの利用に関わる一切の関係に適用されます。
本規約の内容と本規約外における本サービスの説明・ヘルプ及びＱ＆Ａ・投稿・ガイドライン、プライバシーポリシー等（以下、総称して「規定」といいます。）との間で齟齬がある場合は規定が優先して適用されるものとします。

第2条（患者様による本サービスの利用）

患者様は、本規約を読み、理解したうえで、本サービスを利用するものとし、本サービスを利用した場合には、本規約に従うことに同意したものとみなします。
患者様は自らの意思によって本サービスを利用するものとします。
患者様は本サービスの利用にあたり、当院からの要請に応じて、患者様の正確な情報を提供し、登録した情報の内容が最新かつ正確なものであることについて一切の責任を負います。
患者様は、患者様が当院に提供した情報に変更が生じた場合、当院に対して速やかに最新の情報を連絡するものとします。患者様は、当院が患者様の個人情報を含む利用者情報を、本規約・規定に定める目的に従って利用し、または第三者に提供することがあることに同意するものとします。
当院は、以下に定める事由のいずれかに該当した場合、患者様に対する本サービスの提供を拒否することができるものとします。

第3 条（診療）

患者様は、当院において対面での診察を受けた後でなければ本サービスを受けられない場合があることに同意します。
患者様は、疾患によっては、本サービスを受けられない場合があることに同意します。
患者様は、本サービスによる診療を受ける際に、送受信される映像が不鮮明である場合等、対面で直接行われる診察と比較して詳細な診療が行えない可能性があることに同意したうえで、本サービスを利用したものとします。
本サービスを通じた診療等は原則として自由診療であり、事前に確定できる料金については、本サービスを提供するためのウェブサイトおよびアプリケーション等（以下、「本サイト」といいます。）上に明示します。 ただし、通常の保険診療と同様に、患者様の健康状況等によって診療内容や費用が異なるため、診療前に金額を完全に確定することができない場合があります。
当院では、処方箋の発行、医薬品の処方について、患者様の健康状況等に応じて当院の医師が判断するものとし、患者様が医薬品を指定したとしても応じることが出来ない場合があることに同意します。

第4 条（免責）

Article 4 (exemption)

当院は、患者様が提供した個人情報を含む利用者情報、及び、第三者の情報に関し、内容の正確性、有用性、完全性等について何らの保証をしないものとします。
当院は、本サービスの利用に関し、以下のことを保証しないものとします。

当院は、患者様の本サービスへの登録および本サービスの利用から生じる損害に関して、当院の故意または重過失により発生した場合を除き、一切の責任を負わないものとします。当院が責任を負う場合、患者様は、当院の責任が直接損害に限られること、 及び、当該患者様に対して賠償する損害の累計額は、当院が本サービスに関連して当該患者様から受領した本サービス利用料の合計額を上限とすることに同意するものとします。
当院は、当院による患者様情報の変更、削除または消失、本サービスの内容の変更、本サービスの提供の停止または終了、本サービスの利用不能、本サービスの利用によるデータの消失または機器の故障若しくは損傷、その他本サービスに関連して患者様が 被った損害につき、一切責任を負わないものとします。ただし、消費者契約法等の強行法規が適用される場合には、当該規定適用後に適法とされる範囲でのみ、当院の責任は免責されるものとします。
患者様の情報が変更・削除された場合、本契約が解除された場合、本サービス内容が変更された場合、または本サービスが停止・終了した場合においても、患者様と当院に所属する医師との間で成立する診療契約の内容に影響を及ぼすものではありません。 当院は、患者様よる本サービスの利用により、患者様の疾病・疾患が治癒し、診療等が終了することを保証するものではなく、また、当院に所属する医師が患者様の診療等を開始・継続することを保証するものではありません。
患者様は、本サービスの利用による処方箋の発行及び医薬品の配送について、当院がお伝えする配送日数が一般的な目安であり、その日時に到着することを保証するものでないことについて合意し、当院の故意または重過失が認められる場合を除き、 配送の遅延等による損害に関して、一切の責任を負わないものとします。なお、配送日を過ぎても処方箋・医薬品が到着しない場合、患者様は当院に対して速やかに連絡をしなければなりません。

We agree that the total amount of this service usage fee received from the patient is the upper limit.
Our hospital will change, delete or lose patient information by our hospital, change the contents of this service, suspend or terminate the provision of this service, cannot use the service, loses data or devices by using this service. We shall not be liable for any failure or damage, or the damage caused by the patient in connection with this service. Provided, however, that in the case of a consumer contract law, etc., the responsibilities of our hospital shall be exempted only within the extent that is legally applied after the application.
If the patient's information is changed or deleted, if this agreement is canceled, the content of this service is changed, or if the service is suspended or terminated, the patient and a doctor belonging to our hospital. It does not affect the contents of the medical contract established in between.
Our hospital does not guarantee that the patient's illness and disease will be cured and medical treatment will be terminated by the use of this service, and doctors belonging to our hospital are medical treatment, etc. It does not guarantee that you will start and continue.
The patient agreed that the number of delivery days informed by our hospital is a general guide and does not guarantee that it will arrive at the day and time regarding the issuance of prescriptions and delivery of drugs based on the use of this service. Unless the intentional or gross negligence of the hospital is found, it shall not be liable for any damages due to delivery. If the prescription or drug does not arrive after the delivery date, the patient must contact our hospital immediately.

第5 条（規約の変更）

Article 5 (Change of Terms)

当院は、患者様の承諾を得ることなく、本規約を変更することができ、本サイト上に表示された時点より効力を生じるものとします。

第6 条（損害賠償）

患者様が本規約の各条項に違反し、当院または第三者に対して損害を与えた場合、患者様は当院または第三者に対し損害賠償義務（弁護士費用等の紛争解決に要する費用を含む）を負うものとします。

第7 条（患者様情報の取扱い）

当院は、本サービスにおける個人情報の取扱いについて、本規約や規定に定めるほか、個人情報の保護に関する法律、東京都個人情報の保護に関する条例、医療・介護関係事業者における個人情報の適切な取扱いのための ガイドライン（厚生労働省）等の関連法規等を遵守し、個人情報の適切な管理に努めます。
当院は、患者様の個人情報を含む利用者情報を収集・利用する場合、本規約・規定に定める目的に従って、利用目的の達成に必要な範囲で適切に行います。その他の目的で個人情報を収集・利用する場合には、 収集目的を予め通知または公表したうえで実施いたします。ウェブサイトで個人情報を必要とする場合も同様にいたします。
当院は、従業員に個人情報を取り扱わせる場合、または、個人情報の取扱いの全部または一部を委託する場合、個人情報の安全管理が図られるよう必要かつ適切な監督を行います。

第8 条（暴力団等排除条項）

第9 条（準拠法および管轄裁判所）

Article 9 (Authorized law and jurisdiction court)

本サービス、本規約および規定に関する準拠法は日本法とします。本サービス、本規約および規定に関して生じる一切の紛争については、横浜地方裁判所を第1 審の専属的合意管轄裁判所とします。

The compliant laws related to this service, these Terms and Conditions shall be Japanese law. Regarding any dispute that occurs in the Service, these Terms and the Conditions, the Yokohama District Court shall be the exclusive jurisdiction of the first instance.

本規約に同意いただける場合、薬局の選択を当方にお任せいただくことを了承したものといたします。
